Alleged burglar beaten by shop owner

When David Dee Smith, owner of Smith’s Auto Body at 310 Cherokee in Sallisaw went to his business at 9 p.m. Nov. 25, he noticed a window broken on his door he didn’t expect to see a man inside.

Smith said a silent alarm went off at his shop, which caused him to drive to his shop and check the building. He said when he walked inside the building with the lights off he saw a large figure walking around near one of the rooms inside.

“My heart skipped a beat,” Smith said. “A man holding a little flash light was roaming around in the dark. When the man noticed I was standing there he darted toward me,” Smith said. “There was one way out of the building and I was standing near it. He tried to pass me but he never made it.”

Smith said the figure darted toward him and started throwing punches so the fight began. Smith knocked down the alleged burglar, Anthony Lutes, 42, of Sallisaw before Lutes could make contact or reach the door.

According to the police report, after Lutes was knocked down he kept trying to fight Smith. Smith got on top of the man to try to hold him down but Lutes kept trying to hit Smith.

“He kept wiggling around, I was trying to protect myself. This man was huge,” Smith said.

Smith said he is a little over 5 feet tall and the man he was facing is well over 6 feet.

Sallisaw Police Officer Tucker Martens reported Smith started fighting back and tried to subdue Lutes.

“When the man wouldn’t stop trying to fight, Smith found a medium sized log laying on the ground near the struggle and struck Lutes on the head several times trying to keep Lutes down and make him stop fighting,” Martens, reported.

Smith’s wife called the Sallisaw Police Department and asked for assistance. When Sgt. Jeff Murray arrived the fighting stopped. Murray called an ambulance that arrived shortly and paramedics treated Lutes who was bleeding from a wound on the back of his head. Murray reported Lutes had several wounds to his face.

Lutes was medically cleared then booked into the Sallisaw City Jail. He was transported to Sequoyah County Jail and released on a $4,000 bond.

Smith said Lutes had car titles in his pockets. He said he believed he was trying to steal them.

Lutes was charged with second-degree burglary Tuesday in Sequoyah County District Court, Sallisaw.

Lutes has several previous felony charges in Sequoyah County which include conspiracy to commit a felony, theft of credit cards, knowingly concealing stolen property, possession of credit cards belonging to another, taking debit cards, larceny of a controlled dangerous substance, assault and battery, stalking, petit larceny, resisting an officer, and now second degree burglary.

“I’m hoping he learned his lesson this time,” Smith said. “I was protecting myself and my business.”

You know that I read everyones comments and I don't understand some of you. This man broke into Mr. Smith's business and was helping himself to stuff that didn't belong to him. This man has taken from me so I understand that Mr. Smith did the right thing. I'm a widow and on a fixed income and what this man took from me was a big issue to me, maybe not to him. I know this man and personlly I can't stand him because he is a theif. I commend you Mr. Smith for what you did and I believe that if more of the people of this town did the same there would not be a problem. I can only hope that justice be served this time and this man is taken off the streets never to be allowed to do this to anyone else.

From the looks of the picture, he wasn't a fighter until he was cornered like an old wild cat. Looks like he stood in front a rock em sock em robot.

As for the before and after pictures. It appears that the Times is shrinking down to tabloid status in order to sale the paper. What reasoning does the times take for even printing and showing this picture other than using this mans bad luck to sale, sale, sale.

I know this guy and he is not a fighter. Everyone wants to blame the Justice System. Yet no one wants to fork over the money to build new prisons, or to inlarge the ones we got. If you find his picture on the DOC web site then he has gone to prison. Unless you give a life sentence without parole for every crime your going to see these guys over and over. It's not so much the justice systems as it is the repeat offender who decides to repeat his crimes time and time again. People think that the District Attorneys office is there to represent the victim and that's not true. People think the judge is there to represent the victim and that's not true either. I can see why most hate what they don't understand. Learn not whine is what we should be doing.

Way to go Mr. Smith. Sorry to say our tax dollars will still have to board and feed another common criminal but at least we all feel alittle satisfaction was attained with the arrest this time. Hats off to you!!!!

To work hard all your life for everything you have and to be able to live, eat and pay taxes is a major undertaking. I can't blame the people for bashing the faces of druggies and thieves because the justice system doesn't protect us. It just allows the criminals to work for them by coming in and out of the courts and pay a monthly fee to stay out of jail so they can continue to and make, sell, and use their drugs and steal from the innocent. Such as the case for Asher and Lutes. Both of these people have been arrested and convicted many times only to get charges reduced and deferred, and set up on a monthly payment plan. People are tired of this revolving door system and are taking the matter into their own hands and I can't blame them. But most people are afraid they will be sued for protecting their lives, family and property and have entrusted the justice system to protect them and it just isn't working. If someone kills a thief caught in the act, the real blame should be placed on the court system & judges for not doing their job to begin with. Criminals are protected and have more rights than victims. I think it's time for a change even if it means killing someone because that is a sure way to stop someone from ever commiting a crime again. You can't blame law enforcement officers for not doing their job when they've already arrested someone several times only to see the criminals out doing their stealing and killings again. Take a stand people and excerise your rights. Do what you gotta do and maybe this will get the judes and district attornies attention. I know it will make the criminals think harder before taking a chance.

I agree about getting what a criminal deserves 100%. but am I missing something? How did they get that "before" picture? looks like the same background to me.and the before picture shows somes scrapes, but that "AFTER" picture,....!! Did the owner of the shop have any help in the beating? But hopefully his life of crime is over .I guess that before picture was one on file from previous arrests......???

Arrested this guy once. He has more brain power to get in trouble than stay out of it. In a fight people get turned and it's sort of hard to take notes on what really haappened while your in the middle of a life changing event. But this guy surely is addicted to OPP (other peoples property). Maybe this will be reason enough for him to find a new line of work. I do think that the Times could have done without the before and after pictures. It only raises the question of, at what point was this guy unable to fight and the shed whipping continue? Sort of complicates the case. But looking at the picture it probably won't matter if this guy does any time. It looks as tho what was given to him was far worse than any amount of time that could be given him. In other words, Lesson learned (Hopefully). This should be a lesson for all those wanting to get into the thug way of life. Mess with the bull and you will get the hard side of the stick.
