An application to revoke bond for a 74-year-old man who was charged with assault and battery with a dangerous weapon Sept. 2 was filed Tuesday in Sequoyah County District Court, Sallisaw.
Andy Delbert Mannon of Vian was released on a $10,000 bond on Aug. 30 from the Sequoyah County Jail. Mannon was arrested Aug. 30 after he and neighbor Sparkle Curran, 31, had an altercation over a fence.
John David Luton, first assistant district attorney, filed the application to revoke Mannon’s bond to insure Curran’s safety after he became aware of an event that took place involving Mannon.
According to court records Mannon stood outside of Curran’s home Tuesday and was threatening Curran’s life. Mannon was also throwing rocks at her house and reportedly said he intended to, “Kill the ______.”
Amanda Grizzle, victim and witness coordinator for the district attorney’s office, said the application to revoke bond would be presented to Special District Judge Dennis Sprouse. Sprouse will make the determination to revoke Mannon’s bond based on the facts presented. She said if the bond is revoked then a warrant for Mannon’s arrest will be issued.
According to the report filed Aug. 30 with the Sequoyah County Sheriff’s office, Curran told deputies that Mannon was trying to push down the fence surrounding her property where she keeps her horses. Curran said she went outside to stop him from letting her horses get out. She told deputies that Mannon struck her in the left elbow with a piece of fence pipe. Curran said that Mannon kicked her in the rear and pushed her into the fence causing her to cut her arm.
Curran told deputies that when she started yelling for her husband to help Mannon told her, “Go ahead and yell I’ll go home and get my gun.”
After the Aug. 30 incident between Mannon and Curran, Curran filed for an emergency protective order. According to personnel in the Sequoyah County Court Clerk’s office, a judge denied the protective order because Mannon is not a person related to Curran and the order being requested did not meet statutory requirements.
Luton explained that the emergency protective order which Curran was requesting is limited to people living within the same house, people who are or where dating and family members or stalkers.
According to the application to revoke bond for Mannon, “The purpose of bond is not only to ensure the defendants appearance at trial but also to protect the public from the defendant. Clearly, the serious threats made by the defendant to the victim indicate the public’s safety and certainly that of the victims are at risk from the defendant.”
Mannon has a preliminary hearing scheduled at 1:30 p.m. Oct. 13 in Sequoyah County District Court, Sallisaw.
