Editor’s Note: Nolo contendere, a plea meaning the defendant neither admits nor denies a crime was committed but agrees to a punishment as if guilty.

Dennis Wade Osburn, 44, of Sallisaw entered a plea of nolo contendere on Nov. 3 in Sequoyah County District Courof for a crime that was allegedly committed in August 2005.

Osburn was charged with forcibly fondling and lewdly exposing himself in the presences of a minor.

The report from the Sequoyah County Sheriff’s office states that Osburn was watching a 12-year-old female while her mother was out for the evening. The minor was sleeping in her bed when she felt someone touching her.

The report states the minor told Deputy Shane McHale, she saw Osburn in her room after she was awakened by someone touching her. The minor also stated in the report that Osburn exposed himself to her previously.

Osburn was convicted of sodomy in the district court Nov. 3.

He was sentenced to a term of one year in the Sequoyah County Jail and spent that term from Sept. 19, 2007, thru Nov. 3, 2008. Osburn also received seven years suspended sentence under the custody and control of the Oklahoma Department of Corrections. He must also register as a sex offender once a year for 15 years.
