Charges stem from an alleged sexual relationship with a female inmate who was formerly housed in the town’s jail. Day waived his preliminary hearing on April 16.
According to the District Attorney’s office, Michael Daffin, who is Day’s defense attorney, asked to reschedule the plea hearing for a later day due to a scheduling conflict.
Sequoyah County Undersheriff Roger Fuller a deputy at the time, wrote in his report that the sheriff’s office was requested by Roland Police Chief Tommy Sessums on Aug. 2 to investigate allegations of a town employee having sex with a female inmate.
On Aug. 8 Fuller met with Day, who allegedly told him that he had “acted somewhat inappropriately” as he had taken an inmate across the state line into Van Buren, Ark., to Walmart. He denied any other type of inappropriate behavior, Fuller reported.
According to the charges, the woman described multiple occasions that she allegedly had sexual contact with Day in his office and other locations, the first occasion was allegedly on June 27 at Day’s office in the Waylon Jones Complex.
The woman told police that she and Day had a conversation about some pictures of her buttocks that the woman had on her cellular phone. The woman told police that Day allegedly told her what needed to be cleaned at the complex and then gave her a digital camera and told her he wanted her to take photos of herself for him.
When Day waived his preliminary hearing a plea hearing was set for May 14. According to Assistant District Attorney Ryan Wyrick who is handling the case Day’s new plea hearing is set for 1:30 p.m. June 22 before District Judge Jeff Payton.
