A Sallisaw man accused of sexually assaulting a 12-year-old girl will face a preliminary hearing in Sequoyah County District Court, Sallisaw, on Friday, according to court records.

Justin Wayne Spurgeon, 20, is charged with two counts of rape by instrumentation and two counts of lewd molestation. Spurgeon was arrested and booked into the Sallisaw City Jail on July 1 and transferred July 3 to Sequoyah County Jail in Sallisaw. Spurgeon is currently being held on $75,000 bond, according to jail records.

According to court records, the 12-year-old told police that Spurgeon come into her room while she was sleeping and began to touch her inappropriately.

When police went to the residence to speak with Spurgeon about the allegations against him, Spurgeon began to cry, according to the police report. Spurgeon told police that on June 20 the 12-year-old girl and he were hanging out and she grabbed his private area and he did the same to her. He said he kissed her on the neck and on the lips, but stopped because he knew it was wrong and started to think of the consequences.

The police asked Spurgeon how many times this had happened and according to the report Spurgeon looked down, started to breathe heavily and cry again.

According to a statement given to police by Spurgeon, Spurgeon told police the 12-year-old and he had done several things, which included inappropriate touching. He said he had showed her his penis, but only twice.

According to the police report, the condition of the home the 12-year-old girl lives in was dirty. The police reported several dogs living in the house, and the girl had several bites all over her body, and no one knew what the bites were from.

The 12-year-old girl was taken for medical treatment and it was discovered that she had a highly contagious parasitic skin disease caused by the itch mite. According to the report, the skin disease is most prevalent among people living in crowded and unhygienic conditions. The 12-year-old girl received medical treatment.

According to police more arrests are expected.
