NOTICE OF HEARING TO TERMINATE PARENTAL RIGHTS AND TO ALLOW ADOPTION WITHOUT CONSENT OF ALLEGED FATHER AND TO DETERMINE THAT ALLEGED FATHER NEVER HAD PARENTAL RIGHTS

THE STATE OF OKLAHOMA, TO: Any known father of Baby Girl L.S.I

On the 28th day of October, 2008, an Application was filed in this Court by the adoptive parents seeking an order of this Court to permit the adoption of Baby Girl, L.S.I., without the consent of the putative father and to terminate rights of putative father and to determine that alleged father never had parental rights. Baby Girl, L. S. I., was born on the 12th day of May, 2007, to Heather Jean Vinson. A hearing on said Application is set for the 4th day of December, 2008. at the hour of 1:30 o’clock a.m. In the District Courtroom in the District Courthouse of Sequoyah County, Sallisaw, Oklahoma, before the Honorable Dennis M. Sprouse.

Petitioners have alleged in the Application that said child is eligible for adoption in that the alleged father of Baby girl L.S.I., child born out of wedlock, is unknown, and that no person has acknowledged paternity of said child nor taken any action to legally establish claim to paternity of said child nor exercised parental rights or duties over said child, including failure to contribute to the support of mother of said child to the extent of his financial ability during her term of pregnancy.

NOTICE IS HEREBY GIVEN THAT THE COURT WILL HEAR EVIDENCE IN SUPPORT OF AND IN OPPOSITION TO THE GRANTING OF THE APPLICATION AT THE TIME AND PLACE ABOVE SHOWN WHERE YOU WILL HAVE THE RIGHT TO BE PRESENT AND AN OPPORTUNITY TO BE HEARD AT SAID TIME AND PLACE INCLUDING THE RIGHT TO OBJECT TO THE ADOPTION OF SAID CHILD: YOUR FAILURE TO APPEAR AT SAID HEARING SHALL CONSTITUTE A DENIAL OF YOUR INTEREST IN THE CHILD, WHICH DENIAL MAY RESULT, WITHOUT FURTHER NOTICE OF THE PROCEEDING OR ANY SUBSEQUENT PROCEEDINGS, IN SAID CHILD’S ADOPTION WITHOUT YOUR CONSENT. NOTICE IS HEREBY GIVEN THAT THE COURT WILL HEAR EVIDENCE IN SUPPORT OF AND IN OPPOSITION TO THE GRANTING OF THE APPLICATION TO TERMINATE YOUR PARENTAL RIGHTS. IF YOU DO NOT APPEAR AT THIS HEARING, THE COURT WILL, ON THE DATE AND TIME OF THE HEARING, ENTER AN ORDER TERMINATING YOUR PARENTAL RIGHTS WITHOUT FURTHER NOTICE. YOUR PARENTAL RIGHTS TO SAID CHILD SHALL THEREBY BE TERMINATED IN ACCORDANCE WITH THE LAWS OF THE STATE OF OKLAHOMA.
