Kyle Waters, assistant district attorney, said Thursday that his office just recently received the OSBI report, which prosecutors are still going through. Waters expects that he will know whether charges will be filed in the case in the next week and a half.
Waters said they will review the investigation to decide whether there is enough evidence to file charges, what the possible charge would be, and who would face the charge.
The OSBI was called to investigate by the town's current police chief, Danny Hoover, after a theft at a downtown Vian business was caught on surveillance video. The town's former chief, Jeremy Floyd, resigned as police chief just days before the OSBI was called to investigate, which led some in the town to speculate that Floyd was a suspect.
Floyd has not been arrested or charged in connection to the theft. And OSBI officials said in July that they do not release names of suspects unless someone has been arrested.
The theft occurred at Simon's Ace Home Center, where a nearly $9,000 Cub Cadet utility vehicle was stolen. Joe Paul Simon, the business owner, said in July that the video surveillance which monitors his business showed the entire theft. Simon would not reveal what was on the video, and he was also told by OSBI not to show the video to the press, but at that time, he said it was "evident" who it was.
