Barrett Sentencing Is Monday

Kenneth Eugene Barrett's formal sentencing is set for 10 a.m. Monday after a jury found him guilty in February of assault and battery with a dangerous and first-degree manslaughter for the 1999 death of Oklahoma Highway Patrol (OHP) Trooper David "Rocky" Eales.

Eales was shot during a drug raid at Barrett's home just off Dwight Mission Road northwest of Sallisaw.

After deliberating for nine hours on Feb. 6, the jury came back with the two guilty verdicts and sentenced Barrett to 20 years in prison for the manslaughter charge and 10 years in prison for the assault and battery with a dangerous weapon charge.

The jury found Barrett not guilty on counts three and four of discharging a firearm with intent to kill other troopers.

A pre-sentencing investigation was conducted by the State Department of Corrections, and Sequoyah County District Judge John Garrett will decide whether to make Barrett's sentences concurrent or consecutive.

Barrett's first trial in October 2002 ended after five weeks when the jury deadlocked at 11 to 1 for a first-degree murder conviction.
