Man pleads no contest to rape charges

A 34-year-old man who was accused of having sex with a 12-year-old girl was sentenced Tuesday to 20 years in prison with 10 suspended, according District Attorney Jerry Moore.

Ernesto Garcia Jr. was charged Nov. 12 in Sequoyah County District Court, Sallisaw, with four counts of first degree rape, two counts of pornography, sodomy, possession of a controlled substance, and possession of drug paraphernalia.

On March 10, Garcia waived a preliminary hearing and agreed to make a plea.

On Tuesday Garcia pleaded no contest to first-degree rape before Special District Judge Dennis Sprouse. Sprouse sentenced Garcia to the Oklahoma Department of Corrections.

According to the report, Garcia admitted to having sex with the 12-year-old girl on several occasions. Garcia also told officers he blindfolded the girl and told her not to think of it as being him she was having sex with. He also allegedly admitted to performing oral sex on the girl and taking pictures of her with a digital camera.

“In Oklahoma, first degree rape is an 85 percent crime. This means Garcia will have to serve a minimum of eight and one half years in prison before being eligible for parole. When he is released he will be on supervised probation until the year 2030 and he will have to follow specialized rules and conditions for sex offenders,” Ryan Wyrick, assistant district attorney, said.
