Wrong Parent Is Listed In Press Release; Assistant DA Apologizes

A man listed as owing $2,900 in child support does not, the district attorney's office confirmed Wednesday. The man's name appeared by mistake on the Sequoyah County District Attorney's list of non-paying parents, in a March 17 press release.

Assistant District Attorney Dewayne Littlejohn confirmed Wednesday morning that the name of Kendall Toney should not have been on the list of non-custodial parents who owed child support and did not show up for hearings on March 15.

Kendall Toney is the custodial parent, Littlejohn said, and Lori Toney is the non-custodial parent who owed the child support.

Since the press was issued, Lori Toney has contacted the district attorney's child support division and made arrangements to pay the $2,900 due.

"He has custody of the children," Littlejohn said, "She's the one who owes."

Littlejohn explained, "We never issued a warrant for Kendall Toney. Lori Toney is who the warrant was issued for, and as soon as she contacted us and made arrangements to pay, that warrant was withdrawn."

Littlejohn said he did not know how the mistake happened, but suspects that, since most custodial parents are the mothers, the father's name was listed by mistake.

"There was an error made. We have sullied Mr. Toney's reputation by doing so. It's my mistake and I am sorry about it. We don't want to make mistakes, but we're human and we do," Littlejohn said. "We issued the press release without checking it. We will do it correctly in the future."
