18-year-old accused in alleged assault

A Muldrow teen was recently charged in the alleged sexual assault of a 13-year-old girl, but the boy claims the sexual contact was initiated by the girl.

Juan Martinez Cortes, 18, was charged June 7 with one count of rape by instrumentation and a misdemeanor count of contributing to the delinquency of a minor.

According to court records, Sequoyah County Sheriff's Deputy Cindy Smith received a report of allegations of rape on May 19 from a 13-year-old Muldrow girl.

The girl told Smith that she had attended a party in the Muldrow area on Lee's Chapel Road known as the shale pit the previous night. She attended the party with a man she knew as Juan Cortes, who turned 18 in March.

While at the party, the girl claimed that she was provided with beer, wine coolers and other alcohol. The girl told Smith that after midnight Cortes began kissing her, touched her, and had sexual contact with her.

The two left the location and traveled to a Muldrow home, where they went into a metal building and lay on a mattress. Cortes allegedly pulled down the girl's shorts and touched her again. She then told Cortes to stop, which he did.

On May 21, Smith spoke to Cortes, who admitted to the events that the girl told Smith had occurred on the night of May 19. Cortes said he was aware of the girl's age. He said the contact was initiated by the girl.
