NOTICE OF HEARING APPLICATION FOR TERMINATION OF PARENTAL RIGHTS OF PUTATIVE FATHER, TERRY DALE COX, OR ANY OTHER UNKNOWN PUTATIVE FATHER

TO: Terry Dale Cox or Other Unknown Putative Father

YOU ARE HEREBY notified that an Application of Biological Mother for Termination of Parental Rights of Alleged Putative Father, Terry Dale Cox, or Other Unknown Putative Father has been filed in the District Court of Sequoyah County, State of Oklahoma, on the 11th day of March 2008, for the adoption of ANDI JO TEAGUE, minor child, of whom you are alleged to be the putative father. A hearing on said Application is set for the 11 day of August 2008, at 9:30 o'clock a.m. in the District Courtroom in the Sequoyah County Courthouse in the City of Sallisaw, Oklahoma, with Judge A. J. Henshaw Jr. presiding. Said Application alleges that your parental rights to the minor child, ANDI JO TEAGUE, should be terminated for the reason that you, the alleged putative father, have refused, failed, or neglected to pay for any voluntary support and you have not exercised any parental rights or duties or indicated any interest in the child nor have you supported the natural mother to the best of your ability during her pregnancy.

No person was named as the father on the birth certificate of said child.

The biological mother may be a member or eligible to be a member of the Cherokee Nation and Choctaw Nation. Therefore, the Indian Child Welfare Act of the United States of America and the Indian Child Welfare Act of the State of Oklahoma will be complied with in the above styled case.

It would be in the best interest of the child if your parental rights to ANDI JO TEAGUE, minor child, are terminated and that the adoption be allowed to proceed.

YOU ARE THEREFORE NOTIFIED THAT THE COURT WILL HEAR EVIDENCE IN SUPPORT OF AND IN OPPOSITION TO THE GRANTING OF THE APPLICATION AT THE TIME AND PLACE ABOVE SHOWN, WHERE YOU WILL HAVE THE RIGHT TO BE PRESENT AND AN OPPORTUNITY TO BE HEARD AT SAID TIME AND PLACE, INCLUDING THE RIGHT TO OBJECT TO THE TERMINATION OF YOUR PARENTAL RIGHTS AND TO THE ADOPTION OF SAID CHILD. YOUR FAILURE TO APPEAR AT SAID HEARING SHALL CONSTITUTE A DENIAL OF YOUR INTEREST IN THE CHILD, WHICH DENIAL MAY RESULT, WITHOUT FURTHER NOTICE TO YOU OF THIS PROCEEDING OR ANY SUBSEQUENT PROCEEDINGS, IN SAID CHILD'S ADOPTION WITHOUT YOUR CONSENT, HEREBY ULTIMATELY TERMINATING YOUR PARENTAL RIGHTS TO SAID CHILD IN ACCORDANCE WITH THE LAWS OF THE STATE OF OKLAHOMA. IF YOU WOULD LIKE TO HAVE AN ATTORNEY REPRESENT YOU AT SAID HEARING BUT CANNOT AFFORD ONE, AN ATTORNEY WILL BE PROVIDED FOR YOU.
