The UKB and Cherokee Nation have been at odds over the rights to the Arkansas riverbed. After the Cherokee Nation was granted the rights in the Settlement Act of the Arkansas riverbed, the UKB tribe filed a claim.
UKB Chief George Wickliffe said granting the motion to dismiss the claim "leaves the UKB without a remedy and results in the band being the only entity whose claims were intended to be addressed by the Settlement Act to remain unresolved."
"But given the fact we believe this ruling to be unjust and unfair; we will still proceed with the filing of an appeal," Wickliffe said.
Charles Locust, assistant chief, said the UKB tribe feels they solidly proved their claim as a joint-successor in interest in regards to the Arkansas riverbed settlement.
