Arkansas man faces second-degree rape charge

A 22-year-old Cedarville, Ark., is accused of second degree rape and was charged Tuesday in Sequoyah County District Court, Sallisaw.

The suspect, Christopher James Cheely, is accused of having sex with a 14-year-old rural Sequoyah County girl after she met him Sept. 5 at the Sallisaw football game.

The teenage girl and her mother attended the ball game, then sent text messages by cell phone after the ballgame to meet to go home, Officer DeShawna Barrow with the Sallisaw police said in her report.

Barron reported that the mother said her daughter sent her a text message that she had left the ball game and was with female friends and their cousins. She said she would be home in a short time.

According to the report, then mother went home, but found her daughter was not there. After trying unsuccessfully to find her daughter, the mother was told that her daughter was with Cheely in his blue Chevrolet S-10 pickup truck.

After contacting Sallisaw police, the mother filed an apprehension and detention order, giving police permission to pick up the daughter. After speaking to the girl's friends and relatives, police found the teenager north of Sallisaw with Cheely about 1 a.m. Sept. 6.

Barrow reported she placed the girl under arrest for being a runaway and put her in the back seat of her patrol car. She then talked with Cheely and had the girl's mother and cousin talk with the teenager. The teen admitted that she and Cheely left the ball game and drove to Sallisaw Creek where they talked and then began to kiss. The teenager said Cheely asked her if she wanted to have sex, but that "they did not have to do anything cause he didn't want to pressure her into doing anything that she did not want to do."

Barron reports that the girl said she told Cheely that she was scared and Cheely "told her it would be O.K.," and that the two then had sex and he used a condom.

After the girl's statement, Barron arrested Cheely and placed him in a fellow officer's patrol car.

Barron said the condom was later found at the park and seized for evidence. The teenager was taken to Sequoyah Memorial Hospital in Sallisaw where a collection kit for sexual assault was taken and all clothing items were taken for evidence.

Barron said Cheely was booked in jail without incident.
