The alleged beating took place on June 25 when Donald Gene Allen, 39, of rural Muldrow was arrested and booked into the county jail. The alleged incident took place before a security camera. The tape from the camera was picked up by Federal Bureau of Investigation (FBI) agents the last part of July or in early August, Calbert said.
The FBI was asked to investigate the incident by Special District Judge Dennis Sprouse at the request of Allen's attorney, Bill Ed Rogers of Sallisaw.
The 22-year-old jailer was put on suspension while the investigation took place. Members of the Sequoyah County Criminal Justice Authority, which oversees county jail operations, asked Calbert to also do an in-house investigation.
Upon his release June 26, Allen was treated for injuries at a Fort Smith, Ark., hospital. The injuries, Allen said, included broken facial bones, which required surgery, and other bruises and abrasions.
Judge Sprouse said Tuesday he has not heard anything from the FBI about the investigation, but that is not unusual.
Sprouse said that if the FBI submits a report it could be turned in to either the U.S. attorney's office in Muskogee or to the Sequoyah County District Attorney's office in Sallisaw.
Sprouse said that if the FBI concludes there may have been a violation of Allen's civil rights, the jailer may face criminal charges as well as a civil lawsuit.
