Billy J. Cowan, 25, of the Muldrow area was charged Sept. 26 with the crime, which is punishable by up to 10 years in prison.
Sequoyah County Sheriff's Deputy Cindy Smith received a report from a woman who alleged Cowan sexually assaulted her in June.
The woman alleged Cowan forced her to perform sex acts on him. She also alleged that Cowan slapped her across the face with his hand and struck her in the ribs. The woman alleged that Cowan threatened he would break her nose if she told anyone about the incident.
According to the affidavit, the alleged victim has been diagnosed as being "somewhat mentally challenged," although the woman had not been evaluated in recent years.
During a July 6 interview with authorities, Cowan admitted to several consensual sexual incidents in May and June with the woman. He denied slapping or hitting the woman or threatening the woman.
He admitted that he had slapped the victim during a previous incident concerning the victim threatening another family member with a knife.
The bruise on the woman, Cowan claimed, came from a time when he was mowing the lawn and the victim got hit with a rock, according to court records.
Cowan is considered an aggravated sex offender and must register as such every 90 days for life. He was convicted in Crawford County, Ark., in July 2004 for lewd or indecent proposals to a child. The victim was listed as a 9-year-old female, according to the county's sex offender registry.
