McMahon strikes pedestrian with his car News Staff Wed, 08/10/2022 - 08:28

A Gore man has reportedly been charged with a felony count of assault, battery, or assault and battery with a dangerous weapon after trying to run over another man with his car.

John W. McMahon, 43, was charged August 2 in Sequoyah County District Court and a bench warrant was issued for his arrest the same day. If found guilty, District Attorney Jack Thorp said the crime is punishable by imprisonment for up to 10 years in the penitentiary or one year in the county jail.

Sequoyah County Sheriff ‚s deputy Charles Webber reported just after midnight on July 28 he was dispatched to S. 4523 Road in regards to a pedestrian hit and run accident where he spoke with the victim.

The victim reportedly had visible cuts and scratches to his hands and arms, and alleged he was hit by a car.

The victim said he was drinking alcohol with some friends at a residence on Moonshine Road, north of Vian, when the people he was riding with left without him. The victim said the man that lived at the residence, Mc-Mahon, offered to give him a ride so he accepted and got into a 2012 Chevrolet Sonic.

The victim said when they arrived at a friend‚s house, McMahon seemed to get angry and started mumbling something that the victim couldn‚t understand, according to the probable cause affidavit. The victim said when he got out of the car and started walking toward the driveway, he heard the engine rev up and tires spinning in the gravel. The victim alleged when he looked back, McMahon drove the car into him, striking him on the back of the legs, causing him to go airborne and land on the hood of the car while it was still moving.

According to the affidavit, Mc-Mahon then slammed on the brakes, causing the victim to fall off the hood and onto the gravel with McMahon allegedly trying to drive the car over him. The victim said he rolled away from the oncoming car and when he stood up, he saw McMahon exit the car and run toward him, swinging his fists and trying to grab him. The victim said he then ran from McMahon, who got back in the vehicle and drove away.

Emergency medical personnel was called to check on the victim‚s injuries and he refused transport but allowed EMS to clean the cuts and scratches to his hands and arms.
