Vian man charged after theft, sale of stock trailer
A Vian man has been charged with a felony count of grand larceny in Sequoyah County District Court after he allegedly borrowed a stock trailer belonging to another and then sold it without their consent.
A Vian man has been charged with a felony count of grand larceny in Sequoyah County District Court after he allegedly borrowed a stock trailer belonging to another, and then sold it without their consent.
Cayden Flynn, 20, was charged Feb. 6 and a warrant was issued for his arrest the same day, according to court records. He received a $10,000 bond and is now scheduled for a March 1 arraignment before Associate District Judge Kyle Waters.
Sequoyah County Sheriff’s deputy Mark Choate reported on Jan. 28 he spoke with the reporting party at a Vian residence. The reporting party said he let Flynn borrow a 16-foot brown livestock trailer in December but when he contacted him to get the trailer back, Flynn said he’d loaned the trailer to another party. The reporting party said when he contacted the other party about the trailer, he was told the individual had purchased the trailer from Flynn.
The reporting party said when he told Flynn he didn’t have permission to sell or loan the trailer, Flynn allegedly confessed to selling the trailer and said he’d “make it right” with the reporting party, according to the probable cause affidavit. The reporting party said he then gave Flynn 30 days to return the trailer or told him he would file a police report.
The other party told authorities he purchased the trailer from Flynn sometime in August 2022 for $950. He said he asked Flynn for a bill of sale but was never provided with one, according to the affidavit.
Just before 11 p.m. on the same day, Choate said he made a traffic stop on a flatbed truck with inoperable tail and brake lights on Highway 82, and the driver was identified as Flynn. When Flynn’s information was ran through dispatch, it showed he had a confirmed warrant with the Sallisaw Police Department, so he was taken into custody and arrested.
At the department, Flynn agreed to speak with Choate regarding the trailer. According to Flynn, a family member gave him the trailer after he’d fixed it up and then he sold it. Choate’s report was then turned over to the District Attorney’s office for further investigation.
District Attorney Jack Thorp said if found guilty, the crime is punishable by imprisonment in the State Penitentiary for a term of not more than two years or in the county jail for a term not to exceed one year, by a fine not to exceed $1,000, or by both fine and imprisonment, and restitution.
