Dominic X. Guerrero, 26, of Manassas, Va., was charged on Feb. 15 with endangering others while eluding/ attempting to elude police officer, possession of controlled dangerous substance (fentanyl), unlawful possession of drug paraphernalia, and driving with license cancelled/suspended/revoked after he reportedly tried eluding Roland Police officer Tyler Ragan on Feb. 9 on Interstate-40.
He was additionally charged with trafficking in illegal drugs (fentanyl) following the reported overdose.
Ragan said Guerrero was stopped for speeding and claimed he didn’t have his drivers license with him. The officer reported Guerrero then put the vehicle in drive and sped off while Ragan was leaning on it, according to the probable cause affidavit.
Ragan began pursuing the vehicle to Highway 64 towards Muldrow, where Guerrero was passing other cars on the shoulder of the roadway at speeds of up to 100 mph. After going through an intersection at Wilson Rock and Highway 64, Guerrero reportedly left the roadway and drove through a ditch toward a shopping center complex before proceeding back to the access road leading to Wilson Rock.
He then took the alleyway between Piggly Wiggly and Dollar General where he reportedly lost control and hit a dumpster, and then took off on foot.
Ragan and his K9 Rackey pursued Guerrero toward the east side of Sonic and back toward the Dollar General where he attempted to get inside a vehicle. He then tried to gain entry into a third party vehicle before the K9 was deployed and bit Guerrero on his left forearm. As he rolled from the vehicle, the K9 held him down as he yelled to “get the dog off him.” Guerrero was taken into custody and transported to Tahlequah Regional Hospital for treatment of puncture wounds.
During a search, the officer reported finding several pill capsules and aluminum foil with burnt residue in Guerrero’s coat, according to the affidavit. Ragan said the capsules contained a blue powder that he believed to contain fentanyl. The capsules, psychedelic mushrooms and other drug paraphernalia were seized and placed into evidence.
Following a doctor’s assessment of Guerrero, he was released and transported to the Sequoyah County Detention Center. His license was found to be revoked and he had two confirmed felony warrants in Virginia. He pled not guilty and received a $50,000 bond, according to court reports.
At the detention center, one of the officers reported finding a baggie of unknown pills hidden in a docking area where Guerrero reportedly was. The pills were given to the Sheriff’s Office where they were weighed and and sent to the state crime lab for testing.
Shortly after, an inmate was sent to Northeastern Health System in Sallisaw to be treated for fentanyl overdose. The inmate told authorities Guerrero allegedly gave him one of the pill capsules, according to the affidavit.
Guerrero is scheduled to appear for a March 8 felony disposition docket in Sequoyah County District Court on all charges.
District Attorney Jack Thorp said trafficking in illegal drugs is punishable by imprisonment for up to 20 years and a fine of $50,000.
