Incarcerated Roland man charged after forcing himself on inmate
A Roland man incarcerated in the Sequoyah County Detention Center is facing a felony charge of forcible sodomy after allegedly forcing himself on another inmate by force and fear.
A Roland man incarcerated in the Sequoyah County Detention Center is facing a felony charge of forcible sodomy after allegedly forcing himself on another inmate by force and fear.
Garrett J. Hurst, 37, was charged March 15 in Sequoyah County District Court and a warrant was issued for his arrest the same day with a $50,000 bond, according to court records. Following a March 22 arraignment, he is now scheduled for a March 29 felony disposition docket before Associate District Judge Kyle Waters.
Sequoyah County Sheriff’s investigator Cindy Smith reported she received a report on March 9 from an inmate in reference to allegations of sexual assault. The inmate alleged while incarcerated in the jail from Feb. 25 to March 9, he was sexually assaulted by another inmate (Hurst) on two occasions.
He said the two were incarcerated together and he didn’t have any money on his books, so Hurst had reportedly given him commissary items. He said Hurst told him he could pay him back when he received some money on his books, according to the affidavit.
The inmate alleged Hurst became “super flirty” and made sexual comments toward him, and he’d told Hurst he was not interested more than one time. He also stated Hurst had allegedly placed his hands down the front of his jumpsuit and fondled him.
Later that evening, the inmate claimed Hurst told him if he didn’t perform a sexual act on him that he would be beaten, and reminded him that he owed him. Hurst then reportedly told the inmate to meet him in the bathroom where the alleged sexual act took place. Afterwards, he reportedly told him to keep his mouth shut before exiting the bathroom. A second incident reportedly happened two to three days later, according to the affidavit.
Smith interviewed Hurst at the jail on March 10, where he admitted to giving the inmate commissary but did not admit to any type of sexual contact with him, or the allegations against him.
The case was then turned over to the District Attorney’s office for review.
If found guilty of the charge, Hurst could face imprisonment for up to 20 years.
