A Muldrow man is facing a felony charge of aggravated assault and battery in Sequoyah County District Court after he allegedly assaulted an elderly individual, sending them to a local hospital for treatment.
The charge was formally filed against Robert E. Dearing, 35, on March 12 and he is now slated to appear before Associate District Judge Kyle Waters on April 10 for a 9 a.m. felony disposition docket, according to court documents.
Sequoyah County Sheriff’s deputy Charles McGee reported being dispatched to a residence on Treat Road in reference to a man, later identified as Dearing, for allegedly assaulting an individual over the age of 80 and then pulling a knife on the other residents of the home.
When the deputy arrived, Dearing was found behind the home and taken into custody. After a pat down of his person, a sock containing multiple syringes and a spoon, along with a knife were located by the deputy.
The alleged victim told authorities that Dearing started “acting out of control” and then threw the victim across the living room into a television and entertainment center, causing multiple cuts to the victim’s extremities. The victim was then transported to a local hospital for treatment.
If found guilty of the charge, District Attorney Jack Thorp said it is punishable by five years in the penitentiary or up to one year in the county jail, or up to a $500 fine, or both.
